MEDIATION

As an alternative to litigation, parties may decide to use mediation to conduct their divorce.

In mediation, the divorcing parties appoint a neutral third party to help them negotiate a settlement of their divorce.  The mediator, unlike a judge, has no power to impose a decision on the parties.  The mediator’s role is to facilitate the negotiations between the parties.  One of his functions is to manage and reduce the conflict between the parties – essential if they are to reach an agreement.  Though the mediator does not make decisions for the parties, he does make suggestions and assist them to come up with solutions to their conflicts.

Once the parties reach an agreement, the case proceeds in the same way as an unopposed divorce.
