DIVORCE OVERVIEW

South African Divorce Law is based on the so-called “no-fault” principle - this means that the party seeking a divorce in South Africa does not have to prove that he or she is the innocent party and that the other party is the guilty party.  As long as one or both parties claim the marriage has “irretrievably broken down”, the court will grant a divorce.  And except in exceptional circumstances, the matter of who is at fault is not relevant to the financial implications of the divorce, or the custody and maintenance of the minor children.
